These Terms of Use (“Terms”) govern your access to and use of the ApeMotion website and motion‑controlled games (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

ApeMotion provides computer‑vision powered motion games that can run on computers and mobile devices using a camera (webcam or phone camera). Many experiences run directly on the web, and some experiences may evolve over time.

1) Who can use the Service

You may use the Service only if you can form a binding contract with us and are not barred from using the Service under applicable laws.

If you are under the age of majority in your jurisdiction, you may use the Service only with permission and supervision of a parent or legal guardian.

2) Safety and physical activity notice

Motion games involve physical movement. You agree that you will:

  • Play in a safe space free of hazards (furniture, sharp objects, fragile items)
  • Use adequate lighting so motion tracking can work reliably
  • Stop immediately if you feel pain, dizziness, or discomfort
  • Consult a professional if you have medical concerns before engaging in physical activity

The Service is for entertainment and is not medical advice or a medical device.

3) Camera permission and your responsibilities

Some games require camera access to detect body or hand movement. You are responsible for:

  • Granting or denying camera permission using your device controls
  • Using the camera in compliance with applicable laws (including laws related to consent and recording)
  • Ensuring you have the right to use the environment and camera device you are playing on

4) License and permitted use

Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to use the Service for personal, non‑commercial entertainment purposes.

You may not copy, modify, distribute, sell, or lease any part of the Service unless we give you written permission.

5) Prohibited conduct

You agree not to:

  • Use the Service in a way that violates any law or regulation
  • Reverse engineer, decompile, or attempt to extract source code or models except to the extent such restrictions are prohibited by law
  • Interfere with the Service (for example, by introducing malware, attempting to overload or disrupt infrastructure, or bypassing security measures)

The Service may rely on third‑party services (for example, hosting, analytics, or CDNs for model assets). Third‑party sites and services are not controlled by us, and their terms and privacy practices apply when you interact with them.

8) Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non‑infringement.

We do not guarantee that:

  • The Service will be uninterrupted, secure, or error‑free
  • Motion tracking will be accurate in all environments or devices
  • Any specific game feature will remain available indefinitely

9) Limitation of liability

To the maximum extent permitted by law, ApeMotion and its affiliates, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service
  • Unauthorized access, use, or alteration of your transmissions or content

Because some jurisdictions do not allow certain limitations, some of the above may not apply to you.

10) Indemnification

You agree to indemnify and hold harmless ApeMotion and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, or your violation of these Terms.

11) Termination

We may suspend or terminate access to the Service at any time if we reasonably believe you violated these Terms or if we need to protect the Service, our users, or our infrastructure.

You may stop using the Service at any time.

12) Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date above. Your continued use of the Service after changes become effective means you accept the updated Terms.
